By using this Site or accessing any of our services, you consent to these Terms of Service, including, without limitation all terms herein regarding our collection, use and data storage as specified in our Privacy Policy. 

By Purchasing Our Product you agree to receive promotional emails for new offers that may contain affiliate link.

1. Introduction

BizMails provides a business email service that allows users to send and receive emails using their own domain. By using BizMails, you agree to comply with these Terms of Service (TOS), which define acceptable usage and restrictions.

2. User Responsibilities

Domain Ownership: Users must verify domain ownership to use BizMails.

Ethical Use: BizMails must only be used for legitimate business communication. It is not an autoresponder and must not be used for bulk emailing, spam, or marketing blasts.

Legal Compliance: Users are responsible for ensuring compliance with all applicable laws and regulations regarding email usage. BizMails is not liable for any legal issues arising from misuse.

3. Administrator Responsibilities & Account Security

You are responsible for:

Ensuring the confidentiality of your organization's account password.

Appointing competent administrators to manage your organization's account.

Ensuring that all activities occurring under your organization’s account comply with this Agreement.

BizMails is not responsible for account administration and internal management of the service for your organization.

You must take necessary steps to ensure your organization does not lose control of administrator accounts.

If an administrator account is lost, you may specify a process for recovering control. BizMails does not intervene in disputes over administrator access.

4. Prohibited Activities

Users must not use BizMails for:

Sending spam, phishing emails, or deceptive communications.

Bulk emailing, unsolicited promotions, or email blasting.

Engaging in illegal activities, harassment, or fraudulent behavior.

Overloading or harming BizMails’ servers with excessive email traffic.

Hosting, sending, or storing prohibited content, including malware or illegal materials.

Selling, renting, or allowing third parties to use BizMails mailboxes outside of your business organization. BizMails is for your business use only, though you may use it for commercial purposes related to your own organization.

5. Spamming and Illegal Activities

You are solely responsible for the content of your emails and transmissions through BizMails.

You must not use BizMails for:

Illegal activities.

Transmitting content that is unlawful, defamatory, harassing, libelous, invasive of privacy, abusive, threatening, harmful, vulgar, obscene, pornographic, pedophilic, or otherwise offensive.

Content that is racially or ethnically objectionable, offends religious sentiments, promotes racism, or infringes on intellectual property rights.

Junk mail, spam, chain letters, phishing, or unsolicited mass emails.

Content containing viruses, malicious code, or software intended to harm recipients.

If BizMails finds reasonable grounds that you have used the service for any illegal or unauthorized activity, we reserve the right to terminate your account immediately without notice.

6. Complaints & Immediate Termination

If we receive a complaint from any person regarding your activities while using BizMails, we reserve the right to terminate your service immediately.

BizMails is not responsible for any loss of data resulting from termination due to a complaint.

Complaints may include, but are not limited to:

Spam reports.

Phishing or fraud allegations.

Violation of laws or regulations.

Abuse or harassment claims.

7. Additional Restrictions

In addition to all other terms, you shall NOT:

Transfer or resell the Services to any third party.

Provide any service based on BizMails without prior written permission.

Allow user licenses to be shared or used by more than one person (except for reassignment to a new user).

Attempt to disassemble, reverse engineer, or decompile the Services, except as permitted under applicable law.

Use third-party links without agreeing to their website terms & conditions.

Post links to third-party sites or use their logo, company name, etc., without their prior written permission.

Attempt to gain unauthorized access to the Services, systems, or networks.

Use the Services in any way that damages, disables, overburdens, or harms BizMails' servers, networks, or computer systems.

Use the Services to store or transmit malware, viruses, worms, or harmful software.

Interfere with or disrupt the integrity, security, or performance of the Services.

Host, display, upload, modify, publish, transmit, store, update, or share information belonging to another person or entity without their consent (including personal or confidential data).

Violate any local, state, national, or international law while using BizMails.

Use the Services for competitive or benchmarking purposes.

Remove or obscure any proprietary notices within BizMails.

Use BizMails in a manner that threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with other countries, public order, or encourages illegal activity.

Create false identities or mislead anyone about the origin of a communication.

Transmit false or misleading information with the intent to harass, defraud, or cause harm.

Use the Services in a manner that relates to or encourages any activity prohibited by law in India.

8. Server Integrity & Security

Users must not engage in activities that overload or compromise BizMails’ servers.

Our servers are highly secure, but users should regularly back up their emails to prevent potential data loss due to cyberattacks or unforeseen issues.

9. Email Deliverability Disclaimer

BizMails does not guarantee that sent emails will land in the recipient’s inbox.

Whether an email reaches the inbox or is marked as spam depends on the recipient's email provider and the sender's domain reputation.

Users are responsible for maintaining a good domain reputation by following email best practices.

10. Service Plans & Quotas

Different plans offer specific quotas for email aliases and domains.

Unlimited aliases or domains are NOT permitted in any plan, including white-label plans.

Upgrades will only be granted after verification of existing usage to ensure compliance with ethical and business-related email usage.

11. Service Suspension & Termination

BizMails reserves the right to suspend or terminate services without prior notice if:

Users violate these terms or engage in prohibited activities.

Any activity is detected that may harm BizMails' servers, reputation, or compliance with laws.

There is misuse of alias/domain quotas beyond ethical business use.

We receive a complaint about the user’s activities, as outlined in Section 6.

12. Limitation of Liability

BizMails is a software-as-a-service (SaaS) provider and is not responsible for the content of emails sent or received by users.

We do not provide legal protection, nor are we liable for any losses, claims, damages, or violations of the law due to the use of BizMails.

While we strive for reliability, we do not guarantee uninterrupted service, and users should always maintain backups of important data.

13. Changes to Terms of Service

BizMails reserves the right to update these Terms of Service at any time. Continued use of the service after changes are made constitutes acceptance of the revised terms.

15. Inactive User Accounts Policy

BizMails reserves the right to terminate user accounts that remain inactive for a continuous period of 120 days.

In the event of such termination, all data associated with the inactive account will be permanently deleted.

BizMails is not responsible for any data loss due to account termination under this policy.

Users are encouraged to log in periodically to keep their accounts active and prevent unintended data loss.

16. Content Ownership and Usage Policy

You own the content created or stored in your BizMails account.

We respect your ownership rights and do not claim ownership of your content.

Unless specifically permitted by you, your use of BizMails does not grant us (BizMails) the license to:

Use, reproduce, adapt, modify, publish, or distribute your content for our commercial, marketing, or similar purposes.

However, by using BizMails, you grant us permission to:

Access, copy, distribute, store, transmit, reformat, publicly display, and publicly perform your content only as required to provide the Services to you.

We do not access or use your content for any purpose outside of service functionality and compliance with legal obligations.

17. Disclaimer of Warranties

You expressly understand and agree that your use of the Services is at your sole risk.

The Services are provided on an "AS-IS" and "AS-AVAILABLE" basis.

BizMails expressly disclaims all warranties of any kind, whether express or implied, including but not limited to:

Implied warranties of merchantability and fitness for a particular purpose.

BizMails makes no warranty that the Services will be:

Uninterrupted, timely, secure, or error-free.

Use of any material downloaded or obtained through the Services shall be at your own discretion and risk, and you will be solely responsible for any damage to your computer system, mobile phone, wireless device, or data resulting from the use of the Services or downloading any such material.

No advice or information obtained by you from BizMails, its employees, or representatives shall create any warranty not expressly stated in this Agreement.

18. Limitation of Liability

You agree that BizMails shall, in no event, be liable for any:

Consequential, incidental, indirect, special, punitive, or other loss or damage.

Loss of business profits, business interruption, computer failure, loss of business information, or any other loss arising from your use of or inability to use the Service.

19. Indemnification

You agree to indemnify and hold harmless BiMails, its officers, directors, employees, suppliers, and affiliates, from and against any:

Losses, damages, fines, and expenses (including attorney's fees and costs).

This indemnification applies to any claims related to:

Your use of the Services in violation of another party's rights, in violation of any law, or in violation of any provision of this Agreement.

You also agree to indemnify BizMails for any other claim related to your use of the Services, except where such use is authorized by BizMails.

Service Use

The Site allows you to access and use Our Services subject to these Terms and for Personal and/or Commercial Use if mentioned. Additionally, you may not create more than the allotted number of account per Individual/Business and you may not access any account other than your own. We may at our sole discretion and at any time without prior warning, discontinue providing the Services without notice. 

By using our Services, you represent and warrant that

Any and all registration information you submit is truthful and accurate

You will maintain the accuracy of such information

Your use of our Services does not violate any applicable law or regulation or any obligation

Account Registration

You may register to access and use our Services by verified email address through our Account Registration Page. 

In consideration of your Registration and use of the Service, you agree to:

Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data"), and

Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or Information, which we have reasonable grounds to suspect that such is untrue, inaccurate, not current or incomplete, this will be removed as per our Account Termination Policy. 

Account Termination

You hereby agree that we may for any reason and at our sole discretion and without notice, terminate your account, and remove from the Services any content associated with your account. 

Grounds for termination may include but not limited to:

Violation of the letter or spirit of these Terms

Unreasonable account usage

Fraudulent, harassing or abusive behavior

Promotion of adult content

If we believe, in our sole discretion, that a violation of these Terms or any illegal or inappropriate behavior has occurred, we reserve the right to investigate and may take any other corrective action we deem appropriate including Account Termination.

Service Prices & Subscriptions

The Prices on our Site are highly competitive and are inclusive of VAT and all other Taxes (subject to change of such taxes), unless otherwise stated differently. 

All special offers and promotions will be marked as such. 

BizMails is a credit based service and its lifetime credits are for 5 years from the date of using the service. All Subscriptions will be renewed Automatically if opted. At the end of the Billing period/credit uses, we will sign you up and bill you for an additional and equivalent subscription term if you want to purchase further credits. You may change your auto-renewal preferences in your Account. Our credit system may change time to time and you have to be abide by it. 

Quota & Service Use 

BizMail is an inbox provider that operates on your domain. As the domain owner, you are solely responsible for the ethical use of the service. By using BizMail, you acknowledge and accept the following terms:

User Responsibility

You must prove domain ownership to use BizMail.

BizMail does not monitor, store, or access your email content. We only provide Software as a Service (SaaS) for business email communication.

You are fully responsible for any legal, financial, or reputational consequences arising from your use of BizMail.

Permitted Use

BizMail is strictly for one-to-one ethical business email communication.

It is not an autoresponder and must not be used for bulk email campaigns, spam, or any other form of mass emailing.

Any misuse, including unethical or illegal email activities, may result in immediate termination of your service without prior notice.

Server Integrity & Security

Users must not engage in activities that harm BizMail’s servers, including high-volume sending tactics or any action that could degrade server performance.

While our servers are highly secure, we strongly advise users to regularly back up their data to protect against potential data loss due to cyberattacks, system failures, or unforeseen circumstances.

Quota & Service Upgrades

Different plans include specific quotas for email aliases and domain usage.

Unlimited domains or aliases are not permitted in any plan, including white-label offerings.

Additional aliases or domain usage will only be granted after verification of existing mailboxes and confirmation that they are being used ethically.

You can not sale, rent mailbox or allow anyone to use BizMails in any manner other than your business organization, however you can use it for your commercial work. 

By using BizMail, you agree to comply with these terms. Failure to adhere to these guidelines may result in service suspension or termination.

Payments

The use of Our Services is subject to payments being Received & Cleared in accordance with the Services that have been ordered. We currently accept PayPal and major credit cards for payments on all services offered by us through a third party payment processor. 

Please note that you are solely responsible for any taxes/surcharges on amounts you are required to pay in order to obtain services through our Website. 

To protect against fraud, unauthorized transaction e.g. money laundering, claims or other liabilities, we do not collect credit card information but allow our Payment Processor; PayPal to collect the information for the sole purpose of collecting payments from buyers on the Site. We are not exposed to payment information provided by PayPal and/or other Payment Providers and this information is subject to their Privacy Policy. 

Cancellation & Refund Policy

We want you to be fully satisfied with all Services you purchase from BizMails. If you are not satisfied with your purchase, you may request within 30 days from date of purchase for a full refund of the purchase price, minus processing or other additional charges. 

Any order cancelled after the initial 30-day period will not be eligible for a refund. 

Intellectual Property

The Site and its original content, features and functionality are owned by BizMails. and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. 

Termination

We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Site may contain links to third-party sites that are not owned or controlled by BizMails

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit. 

Discrimination and Limitation of Liability

The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. 

To the extent permitted by law, BizMails will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. 

We make no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else, which may be harmful or destructive. 

Governing Law

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the India, without giving effect to any principles of conflicts of law. 

Changes to This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. 

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
